Surrogacy

Surrogacy is legal in India, provided we follow the new surrogacy ART laws of 2023. Commercial Surrogacy is banned in India.

For surrogacy, the gametes of biological couples are only used for treatment.

  • The eggs of the female patient (wife) and husband’s sperm are the only ones used during the treatment.
  • The closest relative of the infertility couple can become the surrogate.
  • A physical and psychological fitness certificate for the surrogate is a must. It needs to be approved by the local surrogacy health board.
  • Surrogacy approval should be obtained from a magistrate court before the surrogacy procedure is undertaken.
